ACQ 370: Acquisition Law - This course is intended for experienced acquisition professionals, typically those who are pursuing Level III DAWIA, FAC-C, or FAC-P/PM certification. The course focuses on legal considerations in acquisition.

Lessons are highly interactive. The instructor will lecture using traditional PowerPoint slides and facilitate discussions.

Students will be assigned Government Accountability Office, Board of Contracting Appeals, and federal court cases to read and to discuss, and will prepare one briefing. Some lessons will also include exercises requiring students to apply their skills in scenario-based problem solving. Pre-course work is required.

Course Objectives:

  • Given appropriate reference material, discuss the constitutional, statutory, regulatory, and decisional authorities applicable to both commercial and  governmental acquisitions.
  • Given appropriate reference material, discuss, support, and defend a given position using the statutes and regulations that govern the ethical conduct of government employees.
  • Given appropriate reference material, discuss the statutory, regulatory, and decisional authorities applicable to data rights in government acquisitions.
  • Given appropriate reference material, identify, discuss, support, and defend the statutory, regulatory, and decisional restrictions applicable to the expenditure of appropriated funds.
  • Given appropriate reference material, discuss the process for prosecuting a protest in a government acquisition and differentiate the various decisions of actual case law.
  • Given appropriate reference material, discuss, support, and defend a given position by applying the concepts associated with performance under government acquisition.
